The tax is different
A new build pays 10% IVA plus 1.2% stamp duty (AJD) in Andalucía, instead of the 7% transfer tax on a resale. On €1.5m that's about €168,000 against €105,000, so compare homes on the all-in figure.
New build or resale: the tax gapEvery stage payment must be guaranteed
Off-plan, you pay in stages before the keys. Spanish law requires the developer to cover every one of those payments with a bank guarantee or insurance in your name, paid into a special account. Your lawyer should see each guarantee before the money goes.
Off-plan and the bank guaranteeTen years of structural cover
Developers must insure new homes against structural defects for ten years. Separately, finishes are covered for one year and habitability for three. Know who to call before you need to.
What the warranties coverDon't complete until it's finished on paper
Before the final payment, your lawyer checks the home is registered as finished and has its occupation certificate, so you can connect utilities and, later, sell or let it.
What a good lawyer checksSnag it properly
Walk the home before completion with a list: doors, tiles, damp, air conditioning, the pool. Anything not right goes in writing to the developer before you sign.
Snagging and completionThe price is the developer's price
Through us you pay the developer's list price, the same as going direct. The developer's side pays us, and we sit on your side of the table.
