Off-plan: the rewards, the risks and the guarantee that protects you.

A large share of the property sold to foreign buyers on this coast is new-build, much of it bought off-plan: paid for in stages while it exists only as drawings and a crane. Done right, it is how you get a modern apartment at today's price with two years to pay the deposit stages. Done carelessly, it is how people learn what a developer insolvency feels like. Both stories are true, so here is the machinery.

How the money flows

Typically: a reservation of €6,000 to €10,000, then a contract payment bringing you to around 20 to 30% of the price, then sometimes further stage payments during the build, with the balance (and any mortgage) at completion, one to three years later. Two facts follow. Your money is exposed during the build, and your final payment is committed at today's exchange and mortgage conditions but paid at completion's: worth managing, as our currency guide explains.

The bank guarantee, the whole point

Spanish law (the Ley de Ordenación de la Edificación, first additional provision, as rewritten by Ley 20/2015) requires developers to secure every euro of your stage payments with a bank guarantee or insurance policy, held against a specific account for that development. If the project fails or misses its contractual deadline, you claim your money back with interest. This is the single most important document in an off-plan purchase: your lawyer confirms the guarantee exists, names you, covers each payment, and that your money goes to the guaranteed special account, never to a general company account. A developer who is vague about the guarantee is a developer you thank politely and leave.

The other checks

The building licence must be granted, not “expected”. The developer's track record: completed schemes you can walk, not renders. The specification annexed to the contract in detail, because “similar quality” is doing heavy lifting in some contracts. Penalties for late delivery. And at the end, the licence of first occupation (in Andalusia now usually a declaración responsable de ocupación filed with the town hall) and a proper snagging inspection before you complete: paying for the snag list is cheaper than living with it.

Who off-plan suits

Buyers with time: the wait is the price of the discount and the spec. Buyers who value warranties and building standards over character. And buyers who want the payment runway: 30% spread over a year while the rest of the money organises itself. It suits nobody who needs the keys this summer, and it rewards the unglamorous virtue of reading contracts, which is what your lawyer is for.

General information, not legal advice. Every off-plan contract and guarantee needs review by your own independent lawyer before any payment.
