Buying from your kitchen in Cork: how power of attorney works.

Here is something the property shows never mention: many foreign buyers are not in the room when their Spanish home completes. A lawyer stands in for them under a power of attorney (poder), and the buyers get a congratulations message and a photo of the keys. Flying out for a twenty-minute signing is optional, and usually skipped.

What a poder actually is

A notarised document authorising your lawyer to do specific things in your name: apply for your NIE, open the bank account, sign the arras, sign the deed at the notary, pay the taxes, connect the utilities. Well drafted, it covers the whole purchase in one document, prepared at the start so nothing waits on paperwork later.

How you sign one from Ireland

Two routes. The usual one: a notary public in Ireland witnesses your signature on a bilingual poder your Spanish lawyer drafts, then the document gets an apostille (the international stamp that makes it valid in Spain) and travels over. Allow a week or two. The DFA apostille is €40, and Irish notary and translation fees vary, so get a quote. The alternative: sign it at the consular section of the Spanish Embassy in Dublin, which is arranged by email and appointment but skips the apostille.

Is it safe?

The sensible worry, and the answer is yes, with the obvious caveats. The power goes to your own independent lawyer, never to the seller's side or the agent. It is limited to the listed acts, it can name the specific property and price, and you can revoke it at any time. The money side stays in your control regardless: funds move from your account, and the completion statement is agreed with you before the notary date.

When we would still say fly out

For the viewing, always: never buy a property you have not walked. For completion, rarely, though if you're taking a Spanish mortgage, check early whether your notary will accept the free pre-signing transparency session (Ley 5/2019) through your lawyer or wants you there in person. The other exception is buyers who simply want the moment, and fair enough: signing for your Spanish home at a Spanish notary is a nice morning. Just know it is a choice, not a requirement, and a saved flight is a saved flight.

General information, not legal advice. Your own lawyer drafts the poder and confirms the signing route that suits your timeline.
